This privacy policy governs your use of the software application Fireground Manager ("Application") for mobile devices that was created by Fintech Solutions, Inc. The Application is designed to assist fire departments and emergency response organizations with incident management and dispatch operations.

User Provided Information

The Application obtains the information you provide when you download and register for the Application. Registration is required to use the Application.

When you use the Application, you generally provide:

• Your name, rank, and department affiliation
• Your email address and contact information
• Incident data, dispatch records, and operational notes you enter
• Personnel and unit information for your department
• Information you provide when you contact us for help

Automatically Collected Information

The Application may collect certain information automatically, including the type of mobile device you use, your device's unique ID, the IP address of your mobile device, your mobile operating system, and information about how you use the Application.

The Application may collect location data from personnel who have enabled location sharing to support incident mapping and unit tracking. Location sharing is opt-in and can be disabled at any time in your device settings or within the Application. Location data is used solely for operational purposes within your department and is not shared with third parties.

Only aggregated, anonymized data is periodically transmitted to external services to help us improve the Application. We may disclose User Provided and Automatically Collected Information:

• As required by law, such as to comply with a subpoena or similar legal process
• When we believe in good faith that disclosure is necessary to protect our rights or the safety of others
• With trusted service providers who work on our behalf and have agreed to adhere to this privacy statement
• If Fintech Solutions, Inc. is involved in a merger, acquisition, or sale of assets, you will be notified of any change in ownership or uses of this information

You can stop all collection of information by uninstalling the Application. You can also request to opt-out via email at [email protected].

We will retain User Provided data for as long as you use the Application and for a reasonable time thereafter. Incident records are retained in compliance with applicable records retention requirements. If you'd like us to delete your personal data, please contact us at [email protected].

We do not use the Application to knowingly solicit data from or market to children under the age of 13. If a parent or guardian becomes aware that their child has provided us with information without consent, please contact us at [email protected].

We provide physical, electronic, and procedural safeguards to protect information we process and maintain. Given the sensitive nature of emergency response data, we apply heightened security measures and limit access to authorized personnel only.

This Privacy Policy may be updated from time to time. We will notify you of any changes by posting the new Privacy Policy at https://physikey.net/fireground-manager-privacy and through an update in the App Store.

By using the Application, you are consenting to our processing of your information as set forth in this Privacy Policy. Processing will take place in New York. If you reside outside New York, your information will be transferred, processed, and stored there under New York privacy standards.

Please read these Terms and Conditions carefully before installing and using the Fireground Manager mobile application (the "Software") operated by FinTech Solutions, Inc. ("us", "we", or "our").

By accessing or using the Software you agree to be bound by these Terms. If you disagree with any part of the terms then you do not have permission to access the Software.

Terms and conditions of the iTunes App Store also apply.

Upon download from the iTunes App Store, a non-transferrable license is granted to install the software on your mobile device for your or your organization's use.

You acknowledge that this software has not been designed to meet your individual or organization's specific requirements and it is your responsibility to ensure that this software meets your operational needs.

The Software and its original content, features, and functionality are and will remain the exclusive property of FinTech Solutions, Inc. and its licensors. Our trademarks and trade dress may not be used without the prior written consent of FinTech Solutions, Inc.

Our Software may contain links to third-party web sites or services not owned or controlled by FinTech Solutions, Inc. We assume no responsibility for the content, privacy policies, or practices of any third-party sites.

You agree to defend, indemnify, and hold harmless FinTech Solutions, Inc. and its employees, contractors, agents, officers, and directors from and against any claims, damages, obligations, losses, liabilities, costs, or expenses resulting from your use of the Software or a breach of these Terms.

In no event shall FinTech Solutions, Inc. be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your access to or use of or inability to access or use the Software. The Software is a supplemental operational tool and is not a substitute for established emergency response protocols, training, or command judgment.

Your use of the Software is at your sole risk. The Software is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied. Fireground Manager is an operational support tool and does not replace or supersede any official dispatch, command, or emergency management systems required by your jurisdiction.

These Terms shall be governed and construed in accordance with the laws of New York, United States, without regard to its conflict of law provisions.

We reserve the right to modify or replace these Terms at any time. If a revision is material we will provide at least 30 days notice. By continuing to use the Software after revisions become effective, you agree to be bound by the revised terms.
