This Privacy Policy describes how FinTech Solutions, Inc. ("FinTech Solutions," "we," "us," or "our") collects, uses, stores, and shares information in connection with the MatchMate Tennis mobile application, Apple Watch application, related services, and websites (collectively, "MatchMate" or the "Application").

MatchMate is a tennis scoring application that allows users to score and manage tennis matches using an iPhone and supported Apple Watch devices.

By using MatchMate, you acknowledge the practices described in this Privacy Policy.

MatchMate does not currently require you to create a user-facing account or provide your name, email address, telephone number, or other traditional account information in order to use the Application.

You may voluntarily provide information to us when you contact us for support, submit feedback, or otherwise communicate with FinTech Solutions. This information may include your name, email address, and the contents of your communication.

When you use MatchMate, the Application processes information necessary to provide tennis scoring functionality. This may include:

• Player and team names entered into the Application;
• Match type and scoring format;
• Match settings and rules;
• Scores, games, sets, tiebreaks, and match status;
• Server and service-order information;
• Match timing information;
• Match events and scoring changes; and
• Information necessary to resume or synchronize an active match.

Player names entered into MatchMate are provided by the user. You should avoid entering sensitive personal information into player or team name fields.

MatchMate may process certain technical identifiers and device information necessary to operate features such as communication between the iPhone application and Apple Watch.

This information may include:

• Anonymous application or user identifiers;
• Device identifiers generated or used by MatchMate;
• Apple Watch device identifiers;
• Push notification tokens;
• Application bundle information;
• Application environment information;
• Device and operating system information; and
• Information necessary to establish, maintain, and troubleshoot synchronization.

MatchMate currently uses anonymous authentication for certain backend functionality. This allows MatchMate to distinguish one installation or user context from another without requiring you to create a traditional MatchMate account.

The free version of MatchMate displays advertisements using Google AdMob.

Google and its advertising partners may collect or process information such as device identifiers, advertising identifiers, IP address, device information, advertising interactions, and application usage information.

The information collected and the manner in which it is used may depend on your location, consent selections, Apple's privacy settings, and whether you have granted permission for tracking.

Where required, MatchMate uses Google's User Messaging Platform to request and manage advertising consent.

Google's handling of information is governed by Google's own privacy policies and terms.

Purchasing MatchMate's Remove Ads feature disables advertising within MatchMate. However, information previously processed by an advertising provider remains subject to that provider's applicable policies and retention practices.

Where applicable, MatchMate may request permission through Apple's App Tracking Transparency ("ATT") framework before accessing the device's advertising identifier or engaging in activities Apple defines as tracking.

You are not required to grant tracking permission to use MatchMate.

If you decline tracking permission, MatchMate will continue to function, although advertisements may be less personalized.

You may change tracking permissions through your device's iOS privacy settings.

Depending on your location and applicable law, MatchMate may present consent options concerning Google's advertising services.

Where Google indicates that privacy options are required or available, MatchMate provides access to Google's advertising privacy choices within the Application.

These choices may allow you to review or modify consent decisions previously made concerning advertising data.

MatchMate may offer in-app purchases, including a one-time purchase to remove advertising.

Purchases are processed by Apple through the App Store using Apple's StoreKit services. FinTech Solutions does not receive or store your full payment card or banking information.

MatchMate receives information from Apple necessary to determine whether an applicable in-app purchase has been successfully completed and whether you are entitled to purchased functionality.

Apple's handling of purchase and payment information is governed by Apple's own privacy policies and terms.

MatchMate uses third-party cloud infrastructure, including Supabase, to support certain Application functions.

Cloud services may be used for purposes such as:

• Anonymous authentication;
• Active match synchronization;
• Communication between supported devices;
• Apple Watch functionality;
• Push notification delivery;
• Application reliability; and
• Related backend services.

Information processed through these services may include anonymous identifiers, device information, push notification information, and active-match information.

We seek to limit information transmitted to our cloud services to information reasonably necessary to operate MatchMate's features.

If you use MatchMate with an Apple Watch, MatchMate may exchange match information between your iPhone, Apple Watch, and MatchMate's supporting services.

This may include scores, match status, player or team names, server information, match settings, device identifiers, and notification information.

These communications are used to provide Watch scoring, synchronization, notifications, and related MatchMate functionality.

MatchMate does not require or intentionally collect precise real-time geographic location information for its tennis scoring functionality.

Third-party services integrated into MatchMate may infer an approximate location from information such as an IP address for purposes including advertising, fraud prevention, security, regulatory compliance, or determining which privacy requirements apply.

FinTech Solutions does not sell your personal information.

We may disclose or make information available to third-party service providers when reasonably necessary to operate MatchMate, including providers of:

• Cloud infrastructure and database services;
• Authentication services;
• Push notification and device communication services;
• Advertising and consent-management services;
• App distribution and in-app purchasing services; and
• Technical infrastructure.

These services may process information according to their own terms and privacy policies.

We may also disclose information:

• When required by applicable law, subpoena, court order, or other legal process;
• When we believe in good faith that disclosure is reasonably necessary to protect our rights, users, or others;
• To investigate fraud, abuse, security incidents, or violations of applicable terms;
• In connection with a merger, acquisition, financing, reorganization, sale of assets, or similar business transaction; or
• With your consent or at your direction.

MatchMate retains information only for as long as reasonably necessary to provide the Application, maintain security and reliability, comply with legal obligations, resolve disputes, and enforce agreements.

Certain active-match and synchronization information may be temporary in nature.

Information maintained by third-party providers may be retained according to those providers' respective retention policies.

Where reasonably possible and legally required, information that is no longer necessary will be deleted or anonymized.

We use reasonable administrative, technical, and organizational measures designed to protect information processed by MatchMate.

These measures may include access controls, authentication, encrypted network communications, database security policies, and restrictions on access to backend systems.

However, no electronic transmission, storage system, or Internet-connected service can be guaranteed to be completely secure. We therefore cannot guarantee absolute security.

Depending on your location, you may have rights concerning personal information, including rights to request access, correction, deletion, restriction, or information regarding how personal information is processed.

You may also have choices available directly through MatchMate, iOS, Google, or Apple, including:

• Changing Apple's tracking permissions;
• Reviewing available Google advertising privacy choices;
• Purchasing Remove Ads to disable advertisements within MatchMate;
• Uninstalling MatchMate;
• Managing applicable Apple privacy settings; and
• Contacting us regarding information associated with your use of MatchMate.

MatchMate is not directed specifically to children under 13, and FinTech Solutions does not knowingly solicit personal information from children under 13.

If we learn that personal information from a child under 13 has been collected in a manner requiring parental consent without appropriate consent, we will take reasonable steps to delete the information.

A parent or guardian who believes a child has provided personal information to us may contact us at [email protected].

MatchMate and its service providers may process information in the United States and other countries.

If you access MatchMate from outside the United States, information may therefore be transferred to and processed in countries whose data-protection laws differ from those of your jurisdiction.

Where required, our service providers may use appropriate mechanisms for international data transfers.

MatchMate uses or interacts with services provided by third parties, which may include Apple, Google, and Supabase.

FinTech Solutions does not control the privacy practices of third parties. We encourage you to review their applicable privacy policies and terms.

MatchMate may contain links to websites or services not owned or controlled by FinTech Solutions.

We are not responsible for the content, privacy practices, security, or availability of third-party websites or services.

We may update this Privacy Policy from time to time to reflect changes to MatchMate, our practices, technology, legal requirements, or third-party services.

When we update this Privacy Policy, we will revise the "Last Updated" date and publish the updated policy.

Where required by law, we may provide additional notice of material changes.

Continued use of MatchMate after an updated Privacy Policy becomes effective constitutes acknowledgment of the updated policy to the extent permitted by applicable law.

These Terms of Use ("Terms") govern your access to and use of the MatchMate Tennis mobile application, Apple Watch application, related services, and websites (collectively, "MatchMate," the "Application," or the "Software") operated by FinTech Solutions, Inc. ("FinTech Solutions," "we," "us," or "our").

Please read these Terms carefully.

By downloading, installing, accessing, purchasing, or using MatchMate, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use MatchMate.

Your use of MatchMate is also subject to applicable Apple App Store terms and conditions.

MatchMate is a recreational tennis scoring and match-management application.

Features may include:

• Tennis scoring;
• Singles and doubles matches;
• Various match and scoring formats;
• Recreational or continuous-play scoring;
• Match timing;
• Match resume functionality;
• iPhone and Apple Watch synchronization;
• Match notifications;
• Advertising-supported use;
• Optional in-app purchases; and
• Other features added from time to time.

Features may change, be added, or be discontinued as MatchMate evolves.

Subject to these Terms and applicable App Store rules, FinTech Solutions grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to install and use MatchMate on supported Apple devices that you own or control, or as otherwise permitted by Apple's applicable usage rules.

MatchMate is licensed, not sold.

Except where expressly permitted by applicable law, you may not:

• Copy or redistribute MatchMate;
• Sell, rent, lease, sublicense, or commercially exploit MatchMate;
• Reverse engineer, decompile, or attempt to derive MatchMate's source code;
• Circumvent security or access controls;
• Interfere with MatchMate's servers or infrastructure;
• Use MatchMate in a manner designed to damage, disable, overload, or impair the service; or
• Use MatchMate for unlawful purposes.

MatchMate is intended to assist users with tennis scoring and match management.

MatchMate is not an official match official, referee, umpire, tournament-management system, or authoritative source of match results.

Users remain responsible for verifying scores, rules, player eligibility, tournament requirements, and official results.

Scoring errors may occur because of user input, device synchronization, software errors, connectivity interruptions, configuration choices, or other factors.

If MatchMate is used during organized, competitive, league, club, school, or tournament play, it is the user's responsibility to determine whether such use is permitted and whether MatchMate's displayed score or functionality complies with applicable rules.

The decision of an authorized tournament official, referee, umpire, league, club, governing organization, or other responsible authority takes precedence over information displayed by MatchMate.

MatchMate may depend upon an iPhone, Apple Watch, Bluetooth, network connectivity, push notifications, cloud infrastructure, Apple services, Google services, Supabase, and other technologies outside FinTech Solutions' direct control.

We do not guarantee that:

• Devices will remain connected;
• Scores will always synchronize instantaneously;
• Notifications will always be delivered;
• An active match can always be recovered;
• Match data will never be lost;
• Advertisements will always load;
• Cloud services will always be available; or
• MatchMate will operate without interruption or error.

Users should maintain awareness of the actual match score independently when MatchMate is used in circumstances where accurate scoring is important.

MatchMate may offer in-app purchases through Apple's App Store.

Purchases are processed by Apple and are subject to Apple's applicable terms and payment policies.

MatchMate may offer a non-consumable in-app purchase that removes advertisements from the Application.

The price displayed by the App Store at the time of purchase is the applicable purchase price.

Once successfully purchased and recognized by MatchMate, advertising ordinarily displayed by MatchMate will be disabled for the applicable Apple account, subject to Apple's purchase and entitlement systems.

Purchases may be restorable through Apple's services where supported.

FinTech Solutions does not independently process refunds for App Store purchases. Refund eligibility and processing are generally governed by Apple's applicable policies.

Versions of MatchMate that have not purchased applicable ad-removal functionality may display third-party advertising.

Advertising may be provided by Google AdMob or other advertising providers selected by FinTech Solutions.

FinTech Solutions does not necessarily endorse products, services, statements, or offers appearing in third-party advertisements.

Your interaction with an advertiser is between you and the applicable advertiser, subject to that advertiser's terms and policies.

Your use of MatchMate is subject to the MatchMate Tennis Privacy Policy.

The Privacy Policy describes how information may be collected, used, processed, stored, and shared in connection with MatchMate.

MatchMate may permit you to enter player names, team names, or other match-related information.

You are responsible for information you enter.

You agree not to use MatchMate to enter or transmit information that is unlawful, defamatory, threatening, abusive, infringing, or otherwise violates the rights of another person.

You should not enter confidential, highly sensitive, medical, financial, authentication, or other unnecessary personal information into player names or other free-text fields.

MatchMate may provide functionality across multiple devices, including iPhone and Apple Watch.

Synchronization may depend on hardware, software, connectivity, permissions, notifications, cloud services, and other factors.

FinTech Solutions does not guarantee instantaneous or error-free synchronization between devices.

When conflicting information exists between devices, users are responsible for verifying the correct match score.

MatchMate, including its software, design, graphics, logos, trademarks, text, interfaces, functionality, and original content, is owned by FinTech Solutions, Inc. or its licensors and is protected by applicable intellectual-property laws.

No rights are granted except the limited license expressly provided by these Terms.

"MatchMate," "MatchMate Tennis," associated logos, and related branding may not be used without prior written permission from FinTech Solutions except as permitted by applicable law.

MatchMate may use, integrate with, or link to third-party products and services.

These may include services supplied by Apple, Google, Supabase, and others.

Third-party services are governed by their own terms, privacy policies, and availability.

FinTech Solutions is not responsible for third-party services, their content, their security practices, their availability, or actions taken by third-party providers.

MatchMate may contain links to websites or services that are not owned or controlled by FinTech Solutions.

FinTech Solutions has no control over and assumes no responsibility for third-party content, privacy policies, products, services, or practices.

Your use of third-party websites and services is at your own risk.

You agree not to misuse MatchMate.

Without limiting the foregoing, you may not:

• Attempt unauthorized access to MatchMate systems or data;
• Interfere with other users' access to MatchMate;
• Circumvent technical protections or usage restrictions;
• Introduce malicious software or code;
• Attempt to manipulate advertising, purchases, or entitlements fraudulently;
• Use automated systems to abuse MatchMate's infrastructure; or
• Use MatchMate in violation of applicable law.

We may restrict or terminate access to services where we reasonably believe misuse has occurred.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MATCHMATE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

FINTECH SOLUTIONS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AND AVAILABILITY.

We do not warrant that MatchMate will:

• Meet your particular requirements;
• Be uninterrupted or error-free;
• Always display an accurate score;
• Always successfully synchronize between devices;
• Preserve all match information;
• Be compatible with every device or operating-system version; or
• Remain available indefinitely.

Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FINTECH SOLUTIONS, INC., ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO MATCHMATE.

This includes, without limitation, damages arising from:

• Loss or corruption of match information;
• Incorrect scores;
• Device or synchronization failures;
• Loss of use;
• Lost profits or opportunities;
• Tournament, league, club, ranking, or competition disputes;
• Reliance upon information displayed by MatchMate;
• Unauthorized access to information; or
• Third-party products or services.

To the maximum extent permitted by applicable law, FinTech Solutions' aggregate liability arising from or relating to MatchMate will not exceed the greater of the amount you paid directly for MatchMate or applicable MatchMate in-app purchases during the twelve months preceding the claim or the minimum amount required by applicable law.

Some jurisdictions do not permit certain limitations of liability, so these limitations may not apply to you.

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless FinTech Solutions, Inc., its affiliates, officers, directors, employees, contractors, agents, licensors, and service providers from claims, liabilities, damages, judgments, losses, costs, and expenses, including reasonable attorneys' fees, arising from or related to:

• Your misuse of MatchMate;
• Your violation of these Terms;
• Your violation of applicable law; or
• Your infringement of another person's rights.

We may modify, update, suspend, or discontinue features of MatchMate at any time.

Updates may be required to continue using certain functionality.

We do not guarantee that any particular feature will remain available indefinitely.

You may stop using MatchMate at any time.

We may suspend or terminate access to MatchMate's online services if you materially violate these Terms, misuse the service, create security risks, or where suspension or termination is reasonably necessary for legal or operational reasons.

Sections of these Terms that by their nature should survive termination will continue to apply.

These Terms will be governed by the laws of the State of New York, United States, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.

Nothing in these Terms deprives a consumer of protections that cannot legally be waived under the laws applicable to that consumer.

If any provision of these Terms is determined to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will remain in full force and effect.

Failure by FinTech Solutions to enforce any provision of these Terms does not constitute a waiver of that provision or any other right.

These Terms, together with the MatchMate Privacy Policy and any applicable additional terms presented in connection with specific functionality, constitute the agreement between you and FinTech Solutions concerning MatchMate and supersede prior agreements concerning the Application.

Applicable Apple App Store terms continue to apply independently.

We may update these Terms from time to time.

If we make material changes, we may provide notice through MatchMate, our website, the App Store, or another reasonable method.

The updated Terms will identify their effective or "Last Updated" date.

Your continued use of MatchMate following the effective date of updated Terms constitutes acceptance to the extent permitted by applicable law.
